Open Knowledgeworker - Terms of Use
Please read these Terms of Use carefully, before registering or
participating in Open KnowledgeWorker. Upon
registration, you confirm that the Terms of Use constitute a binding
legal agreement and that you agree to comply with them. If you do not
agree with the Terms of Use, please do not register and participate in
Open KnowledgeWorker.
For the usage of Open KnowledgeWorker the
following terms and conditions apply. In order to use Open KnowledgeWorker you have to accept the
Terms of Use upon registration.
- In order to become a user of Open
KnowledgeWorker you need to register once at https://open.knowledgeworker.com/ providing
your e-mail address and a password. When setting up your user account
you might be asked to enter further personal information, e.g. your
name and address, in order to confirm your identity. You confirm that
all information entered is accurate, current and complete. Open KnowledgeWorker reserves the right to deny
access in case the data is untrue or inaccurate without prior notice
or justification. Open KnowledgeWorker
treats all your personal data as confidential according to the EU
Data Protection Directive.
- OpenKnowledgeWorker does not guarantee that the service is
always and permanently available.
- Open KnowledgeWorker is not obliged to provide support
services. All support is provided on a voluntary basis.
- All rights of the created contents remain with the user.
However, you agree to provide all contents created with Open KnowledgeWorker under an open license (e.g.
Creative Commons) for other users. The type of license can be chosen
within the publishing of the course, at the end of the creation
process.
- You agree to use Open
KnowledgeWorker in accordance with all applicable laws.
- You agree not to enter any of the following content into
Open KnowledgeWorker.
- racist contents
- contents that glorify violence
- contents containing pornographic elements
- profane contents
- contents that defame, molest or threaten others
- contents that discuss illegal activities with the intent
to commit such activities, or encourage others to commit such
activities
- content containing disabling devices or other harmful
components that may damage, detrimentally interfere with,
surreptitiously intercept, or expropriate the service, data, or
personal information (e.g. viruses, Trojan horses, worms, time
bombs, cancelbots, etc.)
- content containing advertising or promotional materials
- You agree not to enter content (e.g. media, texts) in Open
KnowledgeWorker that infringes or misappropriates rights of third
parties, especially copyrights and intellectual property rights.
- Open KnowledgeWorker reserves the right to delete any such
contents if it becomes aware of it, but is not obliged to do so.
Open KnowledgeWorker has the right to deny access to any user
issuing such contents. In both cases Open KnowledgeWorker is not
obliged to issue a prior warning or justify any deletion.
- If you believe in good faith that a content in Open
KnowledgeWorker infringes your copyright, please use the integrated
abuse reporting facilities or send us an e-mail to info@openknowledgeworker.com,
including evidence of your copyright.
- Open KnowledgeWorker does not
screen, moderate or review any user content. With using Open
KnowledgeWorker you agree that Open
KnowledgeWorker is not responsible or liable for any contents,
postings, entries or links therein.
- Open KnowledgeWorker explicitly
states, that all contents entered by the users are treated as open
contents. There are no limitations regarding collaboration, use,
reuse and publication of the provided contents.
- You agree not to interfere with or disrupt willfully the
services Open KnowledgeWorker provides or
the associated servers or networks.
- Open KnowledgeWorker and its
authorized service providers are entitled to carry out research on
user behaviour among its users. This will not affect your way of
working with Open KnowledgeWorker or your
learning experience. All research respects your privacy.
- The Liability of Open
KnowledgeWorker - for whatever legal reason - is limited to
foreseeable damage, typical for the contract. This limit of liability
does not apply for intent or gross negligence, for loss of life,
bodily injury or damage to the health of a person or under the German
Product Liability Act. The right of Open
KnowledgeWorker to raise a plea of contributory negligence on the
part of the user remains unaffected. Open KnowledgeWorker is not
liable for the actions and contents entered by its users.
- You agree to defend, hold harmless and indemnify Open KnowledgeWorker from and against any
third-party claims, actions or demands arising out of, resulting from
or in any way related to your use of the service, including any
liability or expense arising from any and all claims, losses, damages
(actual and consequential), suits, judgments, litigation costs and
attorneys' fees, of every kind and nature. In such a case, Open KnowledgeWorker will provide you with
written notice of such claim, suit or action.
- These Terms of Use are subject to change at our sole
discretion. Any change to the Terms of Use become effective as soon
as they have been published by us.
- Open KnowledgeWorker is a service
offered by chemmedia AG, located at Parkstrasse 35, 09120 Chemnitz,
Germany. You agree that any dispute arising out of these Terms of Use
or the use of Open KnowledgeWorker is governed by German law. Court
of Jurisdiction is Chemnitz, Germany.
